By accessing our website, making a booking, or joining a trip through GoOut, you agree to the terms and conditions outlined below. These terms are designed to create a clear understanding between travelers, operators, and our team to help every trip run as smoothly as possible.
1. Prices
Prices/rates are valid according to the published date/year and are subject to change at any time without prior notice. Price changes will adjust to fuel costs, currency exchange rates, taxes, government regulations, and other costs beyond GoOutAnyway's control.
2. Reservations and Deposit
All reservations must be made via email or online booking form. A deposit of 30% must be paid no later than 7 days after the reservation date. Payment can be made via transfer to our bank account in Indonesia. The account number will be listed on the relevant invoice.
GoOutAnyway is not responsible for bank fees incurred from transfers made by clients for deposit or full payment. GoOutAnyway reserves the right to offer reserved spots to other guests if the deposit is not received within the specified timeframe.
3. Remaining Payment
Full payment must be made 14 days before the departure date. If full payment has not been received by that date, GoOutAnyway reserves the right to cancel the booking and apply the cancellation policy as described in the Cancellation Policy section below.
4. Last-Minute Bookings
Full payment must be made at the time of booking if the reservation is made less than 14 days before departure.
5. Cancellation
a. Refund Basis
Refund percentages apply to Funds Received (the amount actually received by the Operator after deducting payment gateway or bank fees). Third-party costs (flight tickets, hotels, visas, insurance, etc.) are not included.
b. Policy
- More than 4 months before trip (≥120 calendar days): 50% refund.
- 2 to 4 months before trip (60–119 calendar days): 30% refund.
- Less than 2 months before trip (<60 calendar days): NO REFUND.
6. Rescheduling or Date Changes
a. Financial Handling
Funds Received will be converted into credit, then adjusted with rescheduling fees and rate differences:
- If credit ≥ new price → excess remains as credit for the same guest/party (subject to policy).
- If credit < new price → the difference must be paid for confirmation.
- If rescheduling fee exceeds Funds Received → the difference must be paid for confirmation. Bookings through agents/OTAs will be handled through the original channel.
b. Policy
- More than 2 months before trip (≥120 calendar days): Free (one time) — rate differences apply.
- 1 to 2 months before trip (60–119 calendar days): 20% rescheduling fee of trip/charter price — rate differences apply.
- Less than 1 month before trip (<60 calendar days): Not allowed (processed according to Cancellation Policy).
7. Guest Substitution
If for any reason a guest cannot join a booked trip, the reservation may be transferred to another person. The new guest will be subject to GoOutAnyway's Terms and Conditions. Guest substitution is allowed up to 3 days before departure, or less depending on vessel policy. GoOutAnyway is not responsible for booking changes not made by GoOutAnyway (e.g., flight tickets, hotels, etc.).
8. Pre-Departure Conditions
If a guest does not appear at the meeting point (airport, port, vessel, etc.), GoOutAnyway staff will wait up to 2 hours if notified in advance, or as long as possible (according to the planned departure time and other guests) if not. In both cases, GoOutAnyway cannot be held liable. No-show is considered a last-minute cancellation, and the guest cannot expect any refund.
9. Post-Contract Price Adjustments
In extraordinary and unforeseen circumstances, GoOutAnyway reserves the right to adjust the agreed contract price. Adjustments may be caused by, among others:
- Significant increases in transportation costs, including government-regulated fuel prices.
- Increases in levies, taxes, or fees imposed by the government (such as port fees, sales tax, or embarkation/debarkation fees).
- Major currency exchange rate fluctuations.
GoOutAnyway will provide reasonable supporting documentation to justify any price adjustments upon request. As there are factors such as government-set fuel prices beyond GoOutAnyway's control, a maximum price increase limit cannot be guaranteed or contractually enforced. However, all adjustments are made in good faith, transparently, and in accordance with reasonable commercial standards. Any adjustments are made no later than twenty-one (21) days before the departure date.
10. Force Majeure
GoOutAnyway reserves the right to cancel trips due to force majeure (e.g., natural disasters, pandemics, etc.) or unavoidable human actions (e.g., war, riots, strikes, etc.). In such cases, GoOutAnyway will notify guests as soon as possible. GoOutAnyway's policy for trips cancelled due to force majeure is rescheduling within a maximum period of one year, subject to date availability.
11. Insurance
a. Insurance Object and Coverage
The insured objects are official guests of PT Sea Marine Industry registered for the tour. Coverage Period: 24 hours during the official tour period as stated in the booking/manifest. Covered Activities: recreational and adventure activities in Indonesia including, but not limited to: snorkeling, diving up to 30 meters (with certified divers or under instructor supervision), trekking, sailing, island tours, and similar activities operated or coordinated by the Operator. Not Covered: professional/competitive activities, competition training, or activities outside the official tour program or that violate safety instructions.
b. Benefits (Summary)
- Accidental death.
- Total/partial permanent disability (according to the insurance company's disability scale, e.g., Zurich Indonesia).
- Medical expenses due to accident.
- Emergency medical evacuation & repatriation of remains.
- Funeral expenses.
- Transportation costs.
Note: Benefit limits/amounts are not listed here and are governed by the Insurance Policy Certificate issued by the insurance company. These Terms & Conditions refer to that document as the official source for limits, sub-limits, deductibles, waiting periods, and exclusions.
c. Terms & Exclusions (Summary)
Coverage only applies to registered guests in the final manifest and for activities conducted in accordance with safety briefings, local regulations, and standard operating procedures. Pre-existing conditions, non-accident illnesses, intoxication, illegal acts, and activities outside the official schedule are not covered. Guests must follow crew/guide instructions and use required safety equipment; failure to do so may void insurance coverage.
d. Claims & Procedures
Claim Notification: Guests (or their representatives) must notify the Operator as soon as possible and provide required documents (incident reports, medical records, receipts, proof of identity/booking). Assistance: The Operator will assist with initial coordination with the insurance company/assistance provider; however, claims will be assessed and settled directly by the insurance company in accordance with policy terms. Authority: The Insurance Certificate/Policy and General Terms & Conditions from the insurance company have the highest legal authority in case of interpretation differences.
12. Itinerary Changes and Services
GoOutAnyway reserves the right, if necessary, to change the itinerary during the voyage (e.g., due to weather conditions, etc.). No refunds for unused services, including if conditions beyond our control cause cancellation or changes to services during the trip.
13. Complaints
Any service deficiencies during the voyage must be immediately reported to the tour guide/trip leader on board. If possible, the vessel director will try to find a suitable solution. If the complaint cannot be resolved on board, GoOutAnyway's operations office must be notified in writing no later than 14 days after the trip. GoOutAnyway will resolve the dispute as best as possible within 2 weeks of receiving the complaint.
14. Additional Policies
A fuel surcharge may apply for itinerary changes or increases in fuel prices.
